The process of elaborating EU legislation includes the activity of translation. Drafting and translation cannot be considered separately but are rather two complementary activities whose aim is the quality of legislation. In order to achieve the required quality of legislation, one guiding principle is consistency of terminology. This study examines the particular case of two terms in German that appeared in the EC Treaty: Entscheidung and Beschluss. The inconsistent use of the two terms was the source of interpretative problems, as (...) observed in Case C-370/07 Commission v Council. A comparison of the contested provisions in the EC Treaty and the provisions in the Treaty on the Functioning of the European Union shows that the terminological inconsistency has been corrected. After the examination of this case, we elaborate on the impact of terminological consistency on interpretation as reflected in requests for preliminary rulings. (shrink)

How is it that we think and refer in the first-person way? For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. What is special about the first person has to be reconciled with what is ordinary about it. The range of responses reduces to four basic options. The orthodox view is optimistic: there really is a way of reconciling these (...) apparently contradictory properties as contained within the same thing. The heretical views are pessimistic and content to be so: there is no such way, and that is because there is simply nothing to reconcile – because there is really nothing special about what is in question; or there is really nothing ordinary about it; or there is really nothing …. Lucy Allais presents an original interpretation of Kant's transcendental idealism. She argues that his distinction between things in themselves and things as they appear to us has both epistemological and metaphysical components. Kant is committed to a genuine idealism about things as they appear to us, but this is not a phenomenalist idealism. He is committed to the claim that there is an aspect of reality that grounds mind-dependent spatio-temporal objects, and which we cannot cognize, but he does not assert (...) the existence of distinct non-spatio-temporal objects. On Allais's account, we cannot understand Kant's idealism without a clear account of his notion of intuition and of the role of intuition in cognition: she understands Kantian intuitions as representations that give us acquaintance with the objects of thought. This enables us to make sense of Kant's central argument for his idealism in the Transcendental Aesthetic, and to see why he takes the complete idealist position to be established there. (shrink)

This article examines the experiences of female farmers in the Australian context who neither married into nor were born into farming and how they construct their farmer identity. Drawing on interviews with seventeen first generation female farmers it demonstrates a detraditionalized farmer identity created in response to concern for environmental and social sustainability. They are enabled by an online, global community of practice and shifting narratives of what constitutes responsible farming. Participants leveraged their skills from previous occupations to their farming (...) enterprises to internalize a managerial and entrepreneurial farming identity. First generation female farmers have been empowered as new actors in Australian agriculture, reflecting a disruption in traditional patterns of gendered privilege. (shrink)

'There is nothing outside the text.' Possibly no single statement has caused such a storm in critical theory as this famous observation by the French philosopher, Jacques Derrida. While it is often misunderstood as meaning that nothing is real and that political actions are therefore pointless, Debating Derrida demonstrates that Derrida's philosophy does not lack political conviction. Niall Lucy examines three key terms - text, writing and differance - as they are used in three famous debates: Derrida's disputes over speech-acts (...) with John R. Searle, over discourse with Michel Foucault and over apartheid. Lucy also takes up the issue of Derrida's relationship to postmodernism and questions the 'political imperative' of the need to justify philosophy and the humanities in general according to a notion of their 'usefulness'. Debating Derrida decisively shows that instead of disagreeing with Derrida, we should rather be defending him. (shrink)

Anscombe thought that practical knowledge – a person’s knowledge of what she is intentionally doing – displays formal differences to ordinary empirical, or ‘speculative’, knowledge. I suggest these differences rest on the fact that practical knowledge involves intention analogously to how speculative knowledge involves belief. But this claim conflicts with the standard conception of knowledge, according to which knowledge is an inherently belief-involving phenomenon. Building on John Hyman’s account of knowledge as the ability to use a fact as a reason, (...) I develop an alternative, two-tier, epistemology which allows that knowledge might really come in a belief-involving and an intention-involving form. (shrink)

Ontic structuralists claim that there are no individual objects, and that reality should instead be thought of as a “web of relations”. It is difficult to make this metaphysical picture precise, however, since languages usually characterize the world by describing the objects that exist in it. This paper proposes a solution to the problem; I argue that when discourse is reformulated in the language of the calculus of relations ‐ an algebraic logic developed by Alfred Tarski ‐ it can be (...) interpreted without presupposing the existence of objects. What is distinctive about the language of the calculus is that it contains no operator that resembles a quantifier, and yet it can be used to paraphrase any sentence expressible in first‐order logic. Since the use of a first‐order quantifier (or some similar operator) is usually what establishes commitment to an ontology of objects, and since the calculus of relations eschews the quantifier in favor of a composition operator that can be given a natural interpretation consistent with structuralist metaphysics, the calculus is an ideal language for the structuralist to use to describe the world. In what, if any sense are our torts and our breaches of contract 'wrongs'? These two branches of private law have for centuries provided philosophers and jurists with grounds for puzzlement and this book provides both an outline of, and intervention in, contemporary jurisprudential debates about the nature and foundation of liability in private law.

This is the first book that attempts to analyze and define the metholodology and values of contemporary accounts of adjudication, which can be divided into orthodox philosophies on the one hand and heretical accounts on the other. The author offers an incisive and original analysis of how these supposedly incompatible accounts actually differ.

In this paper, we introduce the Japanese philosopher Tetsurō Watsuji’s phenomenology of aidagara (“betweenness”) and use his analysis in the contemporary context of online space. We argue that Watsuji develops a prescient analysis anticipating modern technologically-mediated forms of expression and engagement. More precisely, we show that instead of adopting a traditional phenomenological focus on face-to-face interaction, Watsuji argues that communication technologies — which now include Internet-enabled technologies and spaces — are expressive vehicles enabling new forms of emotional expression, shared experiences, (...) and modes of betweenness that would be otherwise inaccessible. Using Watsuji’s phenomenological analysis, we argue that the Internet is not simply a sophisticated form of communication technology that expresses our subjective spatiality (although it is), but that it actually gives rise to new forms of subjective spatiality itself. We conclude with an exploration of how certain aspects of our online interconnections are hidden from lay users in ways that have significant political and ethical implications. (shrink)

Like any discipline, bioethics is a developing field of academic inquiry; and recent trends in scholarship have been towards more engagement with empirical research. This ‘empirical turn’ has provoked extensive debate over how such ‘descriptive’ research carried out in the social sciences contributes to the distinctively normative aspect of bioethics. This paper will address this issue by developing a practical research methodology for the inclusion of data from social science studies into ethical deliberation. This methodology will be based on a (...) naturalistic conception of ethical theory that sees practice as informing theory just as theory informs practice – the two are symbiotically related. From this engagement with practice, the ways that such theories need to be extended and developed can be determined. This is a practical methodology for integrating theory and practice that can be used in empirical studies, one that uses ethical theory both to explore the data and to draw normative conclusions. L'évaluation muséale célèbre en 2011 le centième anniversaire de la publication du premier article sur le sujet par Benjamin Ives Gilman. Le présent livre s'adresse autant aux professeurs et étudiants en muséologie, en patrimoine et culture ainsi qu'en tourisme culturel, qu'aux professionnels et aux gestionnaires de musées et des autres secteurs connexes intéressés par les retombées de l'évaluation. Ce guide méthodologique présente les principaux processus auxquels ont recours les évaluateurs en contexte muséal. Les cas présentés ont été sélectionnés en fonction (...) de leur exemplarité et de leur représentativité : tous les types d'études peuvent être réutilisés ou adaptés pour des études similaires. Peu importe l'institution culturelle, l'objet d'étude ou le genre d'évaluation, des outils sont suggérés pour la mener à bien : devis d'évaluation, questionnaires fermés, schémas d'entrevues ouvertes, grilles d'observation, journal de bord, etc. Tirés de la pratique professionnelle de Lucie Daignault, ils témoignent de 23 ans d'expérience professionnelle continue en évaluation muséale au Musée de la civilisation. Fruit d'une précieuse collaboration, le premier texte a été rédigé par le professeur Bernard Schiele. Il y souligne que l'évaluation est vue comme le garant de l'accessibilité pour tous au musée car elle est la condition du maintien du dialogue entre la production culturelle du Musée et ses publics. Anorexia Nervosa (AN) is an eating disorder characterised by self-starvation. Accounts of AN typically frame the disorder in individualistic terms: e.g., genetic predisposition, perceptual disturbances of body size and shape, experiential bodily disturbances. Without disputing the role these factors may play in developing AN, we instead draw attention to the way disordered eating practices in AN are actively supported by others. Specifically, we consider how Pro-Anorexia (ProAna) websites—which provide support and solidarity, tips, motivational content, a sense of community, and understanding (...) to individuals with AN—help drive and maintain AN practices. We use C. Thi Nguyen’s work on epistemic “echo chambers”, along with Maria Lugones’ work on “worlds” and “ease”, to explore the dynamics of these processes. Adopting this broader temporal and intersubjective perspective, we argue, not only helps to further illuminate the experiential character of AN but also has important clinical and therapeutic significance. ABSTRACTA widespread view in the philosophy of mind and action holds that intentions are propositional attitudes. Call this view ‘Propositionalism about Intention’. The key alternative holds that intentions have acts, or do-ables, as their contents. Propositionalism is typically accepted by default, rather than argued for in any detail. By appealing to a key metaphysical constraint on any account of intention, I argue that on the contrary, it is the Do-ables View which deserves the status of the default position, and Propositionalism (...) which bears the burden of proof. Seen as contributing to human enhancement, implanted technologies have recently been receiving a lot of attention. However, reflections on these technologies have taken the shape of rather speculative ethical judgments on “hyped” technological devices. On the other hand, while science and technology studies and philosophy of technology have a long tradition of analyzing how technological artifacts and tools transform and configure our lives, they tend to focus on use configurations rather than the intimate relations brought about by implanted technologies. Even (...) the cyborg has lost some of its hermeneutic power as it has been detached from its material grounds, becoming a discursive entity. In this article, I reclaim the importance of materiality and explore how people live with spinal cord stimulation, which is a type of neuromodulation technology. Implanted in bodies and seemingly out of sight, this technology does not cease to matter. Embodiment and incorporation are crucial for people to live well with SCS. Embodying the neuromodulation technology entails groping processes in which gestures are central and an increased intimacy with one’s bodily materiality. Incorporating it is highly relational and entangled with the bodies of loved and distant ones, humans and nonhumans. (shrink)

The literature on patient public involvement and engagement (PPIE) in health research has grown significantly in the last decade, with a diverse range of definitions and topologies promulgated. This has led to disputes over what the central functions and purpose of PPIE in health research is, and this in turn makes it difficult to assess and evaluate PPIE in practice. This paper argues that the most important function of PPIE is the attempt to make health research more democratic. Bringing this (...) function to the fore and locating PPIE in the wider context of changes in contemporary forms of democratic engagement provides greater conceptual clarity over what PPIE in research should be trying to achieve. Conceptualizing PPIE as a form of democratization has a number of benefits. First, theories of what are appropriate, normatively justifiable and workable criteria for PPIE practices can be developed, and this can provide tools to address the legitimacy and accountability questions that have troubled the PPIE community. Second, this work can be used to form the basis of a research agenda to investigate how PPIE in health research operates, and how it can facilitate and/or improve democratic processes in health research. There is a consensus that our culture is already "post-metaphysical." Does this mean that the culture has abandoned the philosophy? This question is not separable in fact from the historical-philosophical relationships between science and philosophy. These relationships determine the contemporary metaphilosophical positions, which are analyzed in the first half. The second and third parts address the metaphilosophical question in the light of Heidegger's position on the "end of philosophy." This analysis concludes that the issue " postmetaphysics or postphilosophy?" refers to (...) another question, envisioned but not settled by Heidegger: are the symbolic forms, known until today (religion, art, philosophy, science), a closed set of transcultural universals or an open set, able to admit new elements in the future? Toda cultura lleva inherente una cultura-de-la-cultura por la que contrae compromisos epistémicos, pues cualquier forma de cultura no es compatible con cualquier forma de conocimiento. La cultura ignorante de sus responsabilidades epistémicas es una cultura irresponsable. Se desarrolla esta tesis en torno a tres tópicos (las “dos culturas”, la permeabilidad cultural de la ciencia, el “efecto Hydra”) y se infieren algunas condiciones mínimas de la responsabilidad cultural epistémica.

During the Covid-19 pandemic we increasingly turned to technology to stay in touch with our family, friends, and colleagues. Even as lockdowns and restrictions ease many are encouraging us to embrace the replacement of face-to-face encounters with technologically mediated ones. Yet, as philosophers of technology have highlighted, technology can transform the situations we find ourselves in. Drawing insights from the phenomenology of sociality, we consider how digitally-enabled forms of communication and sociality impact our experience of one another. In particular, we (...) draw attention to the way in which our embodied experience of one another is altered when we meet in digital spaces, taking as our focus the themes of perceptual access, intercorporeality, shared space, transitional spaces, and self-presentation. In light of the way in which technological mediation alters various dimensions of our social encounters, we argue that digital encounters constitute their own forms of sociality requiring their own phenomenological analysis. We conclude our paper by raising some broader concerns about the very framework of thinking about digitally and non-digitally mediated social encounters simply in terms of replacement. (shrink)

Cette philosophie de l'homme est ancrée dans une méthode qui a reçu le nom d'analyse du langage ordinaire : prêter une attention particulière à la façon dont nous parlons de nous-même et des autres devrait nous permettre (...) d'atteindre des conclusions positives. Lucie Antoniol nous propose ici une interprétation originale du célèbre ouvrage La notion d'esprit (1949) : l'argument de l'erreur de catégorie repose sur des catégories sémantiques et non ontologiques. Amidst ongoing technological and social change, this article explores the implications for critical education that result from a data-driven model of digital governance. The article argues that traditional notions of critique which rely upon the deconstruction and analysis of texts are increasingly redundant in the age of datafication, where the production of information is automated and hidden. The article explains the concept of the ‘educative subject’ within the liberal education tradition, with specific focus on the role of critique and reflexivity (...) in their becoming. It explores how the logics and practices of datafication and automation pose unprecedented challenges to the educative subject, examining three features in particular: the creation of data subjects; the rise of correlationalism; and the move from representation to operationalisation. The article concludes by outlining a research agenda to address the existential challenges posed by data education. (shrink)
